6. Limitation of Relationship

We are not a party to any agreement, contract, negotiation, or transaction between you and any end buyer and have no further role or responsibility once the referral is made.

We do not represent, warrant, or guarantee:

  • The terms, price, or conditions of any offer made by an end buyer;
  • The performance, conduct, reliability, or financial capacity of any end buyer;
  • The completion, closing, or outcome of any real estate transaction.

Any disputes, claims, or issues arising from your interaction or transaction with an end buyer must be resolved directly with that party. Simpler Sale bears no liability or responsibility for the actions, omissions, representations, offers, or agreements of any third-party end buyer.

7. User Eligibility & Responsibilities

You shall not be required to pay more than $250 in JAMS filing fees. Simpler Sale will pay all remaining filing, administrative, and arbitrator fees. Each party will bear its own attorneys' fees unless the arbitrator determines that a claim was frivolous or brought in bad faith.

Class Action Waiver: You and Simpler Sale each waive the right to participate in any class action, class arbitration, or representative proceeding. All disputes must be brought in your individual capacity only.

Small Claims Exception: Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies for small claims jurisdiction.

This Arbitration Agreement survives termination of these Terms and your use of the Website.

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles. To the extent any dispute is not subject to arbitration under Section 19, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Nevada.
